Understanding Shariah
Mahmoud Andrade Ibrahim
In explaining the concepts of Shariah Law, in no way am I suggesting that the Muslims in America should seek to replace American Law with Shariah Law. There are aspects of Shariah Law that we are obligated to use as observant Muslims, such as fulfilling the requirements for marriage, burial and the conditions that make our meat halal.
“Sharia is all about wisdom and achieving people’s welfare in this life and the afterlife. It is all about justice, mercy, wisdom, and good. Thus, any ruling that replaces justice with injustice, mercy with its opposite, common good with mischief, or wisdom with nonsense, is a ruling that does not belong to the Sharia, even if it is claimed to be so according to some interpretation.” — Ibn Qayyim al-Jawziyya (d. 1347)

Sharia is all about wisdom and achieving people's welfare in this life and the afterlife. It is a comprehensive Islamic legal framework that governs various aspects of life, including personal behavior, family matters, business transactions, and societal affairs. Contrary to common misconceptions and misinterpretations, Sharia upholds principles of justice, mercy, wisdom, and good.
At its core, Sharia embodies a system of laws derived from the Quran - the holy book of Islam - as well as the teachings and actions of Prophet Muhammad (peace be upon him). Its primary objective is to ensure the well-being and prosperity of individuals within a society by fostering an environment that promotes fairness, compassion, reasonableness, and righteousness.
Justice lies at the heart of Sharia. It emphasizes treating all individuals fairly regardless of their social status or background. This notion encompasses both individual rights as well as collective rights within a community. The concept emphasizes equitable treatment in legal matters such as criminal justice but extends beyond that to encompass economic fairness through regulations on contracts, property rights enforcement, inheritance laws ensuring fair distribution among heirs based on specified guidelines.
Mercy also plays a significant role in Sharia law. It encourages compassion towards others by promoting forgiveness rather than retribution whenever possible. While justice seeks to establish accountability for wrongdoings committed against others or society at large; mercy aims to offer opportunities for redemption by encouraging individuals to reform their behavior through guidance and support rather than harsh punishment alone.
Wisdom acts as another fundamental principle guiding Sharia law. It recognizes that human beings have limited knowledge and understanding compared to divine wisdom encapsulated within Islamic teachings. Thus rulings are based not only on textual evidence but also on sound reasoning derived from these texts while considering societal context which may evolve over time.
Furthermore; common good forms an integral part of Sharia law framework whereby actions are judged not solely based on their individual merits but also by their impact on society at large A ruling that promotes the welfare of individuals and society as a whole is seen as being in line with Sharia. In contrast; any ruling that promotes mischief, chaos or harm goes against the spirit of Sharia.
It is important to note that interpretations of Islamic law can vary among scholars and jurists, leading to diverse understandings and sometimes conflicting rulings. Unfortunately, these differences have at times led to practices or interpretations that contradict the essence of Sharia. It is essential to differentiate between true Islamic principles derived from original sources and individual opinions or cultural influences that may taint its true message.
Sharia encompasses an ethical framework rooted in wisdom, justice, mercy, and common good. Its objective is to establish a harmonious society driven by fairness and compassion while striving for individual welfare both in this life and the afterlife. It rejects any ruling that deviates from these principles even if claimed otherwise under certain interpretations. Understanding the true essence of Sharia allows us to appreciate its wisdom rather than succumbing to misconceptions surrounding it.
